Documents Foreign Owners Need to Sell Property in Japan

A practical document checklist for foreign owners selling Japanese property, covering identity, address, title, purchase, mortgage, management, lease, and closing records.

Foreign owners do not all need one identical document pack. A resident seller in Tokyo, an owner who recently left Japan, and a person who has lived overseas for years may need different identity, address, signing, registration, tax, and banking evidence. Use this checklist to find records—not to decide by yourself which document is legally sufficient.

Start with the seller's identity, address, and authority

Compare the seller's legal name and address across the property register, passport, residence records, bank, original purchase documents, and any power of attorney. Differences in spelling, order, script, middle names, former names, or address history should be shown to the agent and judicial scrivener before marketing reaches contract stage.

Registration and tax work use different evidence. The judicial scrivener will review title and transfer documents, while the tax professional may need the historical records that support acquisition cost, improvements, and sale expenses.

  • Title and registrationRegistration identification information or title-related records, current registry information, and notices concerning registered owner details.
  • Original acquisitionPurchase contract, important-matters explanation, settlement statement, brokerage invoices, registration costs, and loan records.
  • Capital workInvoices and payment evidence for qualifying improvements, additions, or other work that may be relevant to cost basis or disclosure.
  • Special ownershipInheritance, joint ownership, trust, corporate authority, name change, divorce, or other records that explain how the owner holds title.

If the purchase records are missing, say so early. The National Tax Agency has rules for situations where acquisition cost cannot be established, but the result may be less favorable than using well-supported actual cost. A tax adviser should review the evidence.

Build the property, building, and tenancy file

The exact file differs for a condominium unit, house, land, entire building, or tenanted investment. Start with what a buyer and agent need to understand the asset, its management, condition, rights, obligations, and known issues.

Physical property

Plans, permits, inspections, surveys, boundaries, repairs, equipment, warranties, keys, photos, and known defects.

Condominium

Management rules, charges, reserve contributions, arrears, meeting records, repair plans, parking, pet and move rules.

Tenancy

Lease, amendments, guaranty, deposit, rent, payment history, notices, management statements, complaints, and unresolved issues.

Add mortgage, tax, banking, and remote-closing documents

These records often determine whether the sale can close on time. Ask each professional for a named checklist, deadline, format, validity period, and who will hold the original.

MortgageLender details, loan number, payoff request, repayment instructions, mortgage-release procedure, and any seller contribution.
TaxTax-residence facts, acquisition-cost evidence, improvement and sale expenses, tax-representative details, and documents requested by the adviser.

Address history and an update to the registered owner record may be required. From 1 April 2026, Japan introduced mandatory applications for registered-owner name and address changes. Confirm the required evidence and timing with a judicial scrivener.

Do overseas documents need a Japanese translation or notarization?

Requirements vary by document, issuing country, seller, and transaction. A translation, notarization, affidavit, consular procedure, apostille, or other evidence may be relevant in some cases, but do not order documents until the registration professional confirms what is needed.
